THE CONTEXT: A health care institution is every place, institution, building or agency, whether organized for profit or not, that provides facilities with medical services, nursing services, behavioral health services, health screening services, other health-related services, supervisory care services, personal care services or directed care services and includes home health agencies, outdoor behavioral health care programs and hospice service agencies ( A. WHAT THE BILL DID: The final vetoed version would allow a subscription contract, evidence of coverage, disability insurance policy, group or blanket disability insurance policy (insurers) and the Arizona Health Care Cost Containment System (AHCCCS) to limit coverage to an insured, subscriber, enrollee or member for genetic sequencing if the genetic sequencing is performed on a device that is either produced by a company: a) that is domiciled in a foreign adversary; or b) that is owned or substantially controlled by a company that is domiciled in a foreign adversary, allow insurers and AHCCCS to limit coverage to an insured, subscriber, enrollee or member for a human organ transplant or post-transplant care if either of the following applies: a) the transplant operation is performed in the people's republic of China or the Hong Kong Special Administrative Region; or b) the human organ to be transplanted was procured by a sale or donation originating in the people's republic of China or the Hong Kong Special Administrative Region, and clarify that the organ harvesting prohibitions do not: a) require genetic sequencing or human organ harvesting; or b) limit an insurer to AHCCCS from denying coverage for any valid reason. WHY IT MATTERED: The practical reason for this bill was to set a clear legal boundary for forced organ harvesting instead of leaving the conduct unaddressed. It would allow a subscription contract, evidence of coverage, disability insurance policy, group or blanket disability insurance policy (insurers) and the Arizona Health Care Cost Containment System (AHCCCS) to limit coverage to an insured, subscriber, enrollee or member for genetic sequencing if the genetic sequencing is performed on a device that is either produced by a company: a) that is domiciled in a foreign adversary; or b) that is owned or substantially controlled by a company that is domiciled in a foreign adversary, and would also allow insurers and AHCCCS to limit coverage to an insured, subscriber, enrollee or member for a human organ transplant or post-transplant care if either of the following applies: a) the transplant operation is performed in the people's republic of China or the Hong Kong Special Administrative Region; or b) the human organ to be transplanted was procured by a sale or donation originating in the people's republic of China or the Hong Kong Special Administrative Region, rather than leave the current rule unchanged.
