THE CONTEXT: A COR is responsible for holding a public hearing for determining the actual need of an agency, determining the extent to which statutory requirements of the agency are necessary and being met, receiving testimony from the public about the relationship between the public and the agency and receiving testimony from the executive director and the head of the agency explaining why the agency should continue. Currently, a COR must hold a public hearing on a preliminary sunset review report either when the Legislature is not in session, or before the third Friday in January.

WHAT THE BILL DID: The final vetoed version would provide that a COR or each COR meeting jointly, must hold at least one public hearing and deliver a finalized sunset review report by the last day in January for a preliminary sunset review report.

WHY IT MATTERED: The practical reason for this bill was to give the people who rely on the rule clearer information and a defined reporting process. It would provide that a COR or each COR meeting jointly, must hold at least one public hearing and deliver a finalized sunset review report by the last day in January for a preliminary sunset review report, rather than leave the current rule unchanged.
