THE CONTEXT: Criminal trespass in the third degree is a class 3 misdemeanor and is committed knowingly: 1) Entering or remaining unlawfully on any real property after a reasonable request to leave by a law enforcement officer, the owner or reasonable notice prohibiting entry; or 2) Knowingly entering or remaining unlawfully on the right-of-way for tracks, or the storage or switching yards or rolling stock of a railroad company ( A. WHAT THE BILL DID: The final vetoed version would require a county, city or town, upon the report of the existence of a homeless encampment, to notify the owner to remove the owner's tent, structure or other personal property from the area, require the county, city or town to claim and retain the property for 14 days if the owner does not remove the tent, or other structure, within 24 hours, and state the owner may claim their property within 14 days.
WHY IT MATTERED: The practical reason for this bill was to give the people who rely on the rule clearer information and a defined reporting process. It would require a county, city or town, upon the report of the existence of a homeless encampment, to notify the owner to remove the owner's tent, structure or other personal property from the area, and would also require the county, city or town to claim and retain the property for 14 days if the owner does not remove the tent, or other structure, within 24 hours, rather than leave the current rule unchanged.
